Minimise Conflict Save Money

Below is an overview of our family law procedures

Divorce
We can only apply for divorce in Australia after you have been separated for a period of at least twelve months.

Financial Settlement
At the end of a marriage, you need to decide how to divide your property, money and belongings. A financial settlement is the term used for who gets what after the end of a marriage.

Superannuation
If you are applying for orders about property you are required to make a "full and frank disclosure" to the Court about all of your property and financial resources, this includes superannuation.

What if your spouse is hiding financial assets
The rules require that both you and your former spouse provide details of all your assets, income and resources.

What if your spouse is threatening to sell the property
If you think your former partner may sell your property before you have worked out your financial settlement, we can apply to the Family Court for an urgent order restraining him or her from selling the property.

What financial orders can be obtained
We can apply to the Family Court for orders relating to property, and spousal maintenance

Financial Support for the Children
Both you and your former partner are responsible for the financial support (maintenance) of your children. That responsibility is not changed by:

    separation and divorce
    the children's residence and contact arrangements
    the remarriage of one or both parents

If child support payments are not made, can your former partner see the children
The Court considers child support and contact separately.

Financial Support for Spouses
Spousal maintenance is when one person pays to help financially support their husband or wife (or their former husband or wife) because they are unable to adequately support themselves.
