- The Name of the Club is Wagin Bowling Club (Inc)
- The objects of the Club are :-
- To foster the game of bowls, darts and pool and to promote good fellowship among the members.
- The property and income of the Club shall be applied solely towards the promotion of the objects or purposes of the Club and no part of that property or income may be paid or otherwise distributed directly or indirectly, to members of the Club except in good faith in the promotion of these objects or purposes.
- To affiliate with the Royal Western Australian Bowling Association. The Members shall recognise and accept the RWABA Constitution and by-laws and shall make all decisions consistent therewith. All games of bowls shall be played according to Bowls Australia Constitution by-laws and Laws of the Game of Bowls.
- Definitions
In construing this Constitution, unless the context or such otherwise indicates or requires:
- The Club means Wagin Bowling Club (Inc).
- "The Club Premises" means all land and buildings and structures thereon of which the Club is the bona fide occupier.
- "The Committee" means the management committee for the Club duly elected for the time being in accordance with these rules.

- "The Secretary" means the Secretary for the time being and includes any person temporarily fulfilling that office.
- "The Treasurer" means the Treasurer for the time being and includes any person temporarily fulfilling that office.
- "Rules" means the Constitution and Rules.
- "The Act" means the Liquor Licensing Act 1988 and any amendments thereto, or any other legislation that may replace or supplement this Act. The Act shall form part of this Constitution.
- The Associations Incorporation Act 1987, its amendments or other legislation that may replace or supplement this Act shall form part of this Constitution.
- The Equal Opportunity Act 1984, its amendments or other legislation that may replace or supplement this Act shall form part of this Constitution.
- RWABA includes the trading name of Bowls WA.
- Powers of the Club
- To acquire, hold, deal with and dispose of any real or personal property.
- To open and operate bank accounts.
- To invest its money in any security in which trust monies may be invested, or in any other manner authorised by the rules of the Club.
- To borrow monies upon such terms and conditions as the Club thinks fit.
- To appoint agents to transact any business of the Club on its behalf.
- To enter into any other contract the Club considers necessary and desirable.

- Membership
- Membership shall be open to any person who wishes to further the interests of the Club.
- Persons seeking membership shall make application on a form prescribed by the Committee, nominated and seconded by Full or Life Members of the Club, showing the category of membership requested. The application will be accompanied by any nomination fee prescribed by the Committee. The application will be posted on the Club notice board for a minimum of 14 days before election at a meeting of the Committee. The Committee shall have the right to refuse any applications for membership at its discretion without prejudice or right of the applicant to require an explanation. Four negative votes shall exclude the applicant from admission. The Secretary shall keep a record of the names of members present and voting on that day.
- Each person admitted to membership shall :-
- Be bound by the Rules and By-laws of the Club.
- Become liable for such fees and subscriptions as may be fixed by the Club.
- Be entitled to all advantages and privileges of his/her category of membership.
- New members accepted for full membership after the first day of March in any year shall pay a pro rata subscription for each remaining month of the Club
- Membership Categories :-
- Full Members: Persons of or above the age of 18 years, entitled to exercise the full privileges of the Club, excepting that where a member becomes an employee of the Club he/she shall not hold any office.

- Social Members: Persons of or above the age 18 years who may enjoy the privileges of the Club, but shall not be eligible:
- To stand for any office in the Club or vote in any ballot or at any General Meeting of the Club.
- To propose or second any application for membership of the Club.
- To use the greens except at the specific invitation of a Club Member.
- Junior Members: Persons under the age of 18 years who may enjoy all privileges of the Club, but shall not be eligible:
- To stand for any office in the Club or vote in any ballot or at any General Meeting of the Club.
- To propose or second any application for membership of the Club.
- To invite guests into the Club.
- Life Members: Any member who has given outstanding service to the Club may be elected to Life Membership at the Annual General Meeting upon the recommendation of the Management Committee. They shall have been a Full Member for at least 10 years. Life Members shall enjoy the same privileges of the Club as Full Members and shall be exempt from payment of subsciptions. Any Club Full or Life Members may nominate a person to the Management Committee for consideration as a Life Member. Life members shall not exceed 4 at any one time.

- Restricted Members: A member who desires access to the greens of the Club, subject to their availability and who shall pay a reduced membership subscription as determined by the Management Committee of the Club, but who shall NOT be entitled to:
- Play in any Pennant Competition, Open Event, Club Championship or represent his/her Club.
- Have a vote or accept any position in the management of the Club.
- Play bowls at any other club affiliated with RWABA.
Provided that the Club Selectors may, where no other Full Member is available, select the Restricted Member to play in a Pennant Competition, at home or away, on not more than two occasions in any one Pennant season.
A Restricted Member who contravenes the playing conditions of his/her membership shall forfeit to the Club a sum of money equivalent to the balance of a Full Membership subscription for a full year. Additionally he/she shall permanently forfeit the right to a Restricted membership.
- Honorary Members: Honorary Club membership may be granted without fees to the Club Patrons, the President of the Shire of Wagin or persons deputising for him/her and such dignitaries and sponsors of the Club as the Management Committee shall determine from time to time.
- Temporary Members: A person who on any day is visiting the Club:-

- Guests: Full, Life, Restricted and Social Members may introduce guests to the Club at any time, provided
- His/Her guests shall not exceed five (5) in number at any one time.
- A guest shall not be supplied with liquor in the Club premises except on the invitation and in the company of a member.
- A guest shall be supplied with liquor to be consumed only on Club premises.
- The member intoducing a guest shall be responsible for the proper conduct of his/her guest whilst on Club premises.
A member may at his/her expense and with the approval of the Committee supply liquor to guests, without limitation to the number at a function held by or on behalf of that member at the Club premises.
- Any person who has been refused membership of the Club or who shall be under suspension or expulsion from the Club or any affiliated Bowling Club shall not be admitted as a guest of any member of the Club. Provide that a person refused membership of the Club, but who is a member of another Club competing in aa competition at the Wagin Bowling Club shall be accorded the same privileges as other visiting competitors.
- The Secretary shall maintain an up to date register of members of the Club.
- A member may at any reasonable time inspect the records and documents of the Club.
- Club Year - The Club year shall commence on the 1st of October of each year, when all subscriptions are due. Should any member fail to pay his/her subscription by the 30th of November, his/her membership shall cease at the discretion of the Committee. Membership fees shall be paid before any member shall be eligible for selection in any Pennant or Association event.
Resignation of any member shall be in writing and will take affect only on acceptance by the Committee.

- Discipline
The Committee shall have full power to reprimand, fine, suspend or expel any member who shall give false or misleading information in his/her application for membership or who in its judgement has committed any breach of the Club Rules or By-laws or either in or out of the Club Premises, committed any act likely to discredit the Club or its members, or to impair or affect the proper enjoyment of the Club by other members.
- Any fine imposed shall not exceed the equivalent of subscription for a full member and shall be paid within 14 days unless the Committee grants an extension of time. Non payment will exclude the member from entering the premises until full satisfaction is made.
- A member suspended or expelled shall have the right to appear to a general meeting of members of the Club. A majority of two thirds of members present and voting shall be necessary to overturn the Committees decision.
- The name of a member suspended or expelled shall be advised to RWABA.
- Procedure for Disciplinary Charge
- All complaints shall be made in writing through the Secretary stating the explicit nature of the offence of which the member is accused, and the names of any witnesses to the offence.
- If the Committee decides to proceed with a charge of misconduct seven (7) clear days notice of the hearing must be given to the member accused.
The secretary shall deliver to or forward by registered post a notice to the accused member and complainant at the postal address registered at the Club. The notice will specify the nature of the charge and request attendance at the hearing to be conducted by the Committee. On the application by either party the Secretary shall send a notice to any other member to appear and give evidence provided such application be made not less than three (3) days before the date of the hearing. Should any party or witness be unable to attend the hearing, the Committee may at their sole discretion on application of either party, adjourn the hearing for not more than seven (7) days, at which time they shall decide the case, the same as if all parties were present.
If after the hearing of the evidence, the Committee shall find the charge proven by a majority decision they shall impose an appropriate penalty. The Secretary shall forthwith deliver or post a notice to the member at the postal address registered at the Club, advising him/her of the penalty. If the penalty is expulsion, the name of the member shall be removed from the list of membership forthwith. The member shall be liable for all monies due by him/her at the date of expulsion. No person shall be entitled to take action or proceeding against the Club for or in respect of any suspension or expulsion as decided and shall conform to the decision of the Committee.

- Management Committees
All sub-committees shall report and be responsible to each meeting of the General Committee. The President to be ex-officio a member of all sub-committees.
- Management of the Club shall be vested in the Management Committee elected by members at the Annual General Meeting and consisting of:-
- President
- & 3. Vice Presidents (male and female)
- Secretary
- Treasurer
- Mens' Captain
- Ladies' Captain
- House Committee Co-ordinator
- Bar Committee Co-ordinator
- Green Committee Co-ordinator
- Social Committee Co-ordinator
- Each member of the Management Committee shall appoint his/her required sub-committee members and submit their names to the Management Committee for confirmation and approval.
- No person shall hold more than one position on the Management Committee at any one time.
Committee Members shall hold office for one year. Retiring Committee Members shall be eligible for re-election. A Committee Member filling a casual vacancy shall hold office for the balance of the term of the person whose position he/she filled.
- A quorum of the Management Committee shall be half of its members plus one.
- If the President or Vice President is unable to attend, then a Chairperson nominated by the meeting shall chair the meeting.
- A member of the Management Committee may lose his/her Seat on the Committee for either one of the following:-
- Absence from three or more meetings without leave of absence.
- Found not to be a financial member.
- Duties of Office Bearers:
- The Secretary, unless excused, shall attend all meetings of the Club, keep minutes of such meetings and do such clerical work as may be required by the Management Committee.
- The Treasurer, unless excused, shall attend all meetings of the Club. The Treasurer shall collect all monies and and shall deposit them at the Club bank account to the credit of the Club within seven days of receipt.

- Ballot Procedure
Appoint Returning Officer (not a candidate). Not less than 42 days prior to the Annual General Meeting, call for nominations for all Management Committee positions. Members may nominate for more than one office. Nominations, including members seeking re-election, on prescribed form, shall be lodged with the Secretary, not less than 21 days prior to the AGM. The Secretary shall initial and date nominations and display on Notice Board for not less than seven days after closure of nominations

Members can serve on any sub-committee and may serve on more than one.
- If the number of nominations does not exceed the number required to be elected for any position, the candidate/s nominated shall be declared elected at the AGM. If less than the required number of nominations is received for any office, the Chairperson at the AGM shall call for nominations for such officers and, if necessary, a secret ballot shall be held.
Any person so elected shall hold office until the next AGM.
- If the number of nominations exceeds the number required, ballot shall be conducted as follows:
- Committee fix time and closing date of ballot, which must be at least 3 days prior to AGM.
- Ballot papers shall show separately surname and given name of candidates nominated for each office in respect of which an election is necessary.
- Voting papers shall be distributed to all Life and Full financial members not less than 14 days prior to the closing date of the ballot.
- The Club shall provide a ballot box which shall be locked by the Returning Officer and placed in the Clubhouse to receive the ballot, at the time of distributing ballot papers to members. The Secretary shall supply the Returning Officer with a current register of members eligible to vote in an election, together with a list of members given a postal vote. The order in which names of the candidates nominated for each office appear on the ballot paper shall be in accordance with a draw conducted by the Returnig Officer in the presence of those candidates wishing and able to be present at the draw. All ballots shall be decided on a "first past the post" system.
